The Justices Are Telling Us What They Think About Roe v. Wade

Legal scholar Mary Ziegler argues that the Court’s recent order in Whole Woman’s Health v. Jackson (2021), declining to enjoin a highly restrictive Texas abortion statute, indicates that a majority of justices are prepared to reverse Roe v. Wade (1973) but would prefer to do so in a way that avoids provoking major political backlash.
