You may only use this Site for lawful purposes in accordance with these Terms of Use.  You agree not to use this Site:

Right To Use Licensed Educational Content

Licensed Educational Content. On its Site, the NCC provides educational text, videos, images and related supplementary materials that are owned by the NCC or third-party licensors (“Licensed Educational Content”).  The NCC grants to you a non-exclusive, non-transferable right to access and use the Licensed Educational Content made available on the NCC site solely for educational non-commercial purposes. Unless expressly indicated on the Website that a particular item of Licensed Educational Content is made available to you under alternate license terms, you may not sell or lease the Licensed Educational Content or use it for any other commercial purpose.  Unless otherwise expressly identified on the Website with respect to a particular item, all Licensed Educational Content is provided to the Creative Commons Attribution-NonCommercial-No Derivatives 4.0 United States License (“CC BY-NC-ND 4.0”  available at https://creativecommons.org/licenses/by-nc-nd/4.0/”). 

You are free to, share, copy and redistribute NCC’s Licensed Educational Content if you adhere to the following terms:

  • Attribution — You must give appropriate credit, identifying the NCC as the source of the Licensed Educational Content.
  • NonCommercial — You may not use the material for commercial purposes.

Digital Millennium Copyright Act Notice Procedure

Notification of Infringement

It is our policy to respond to clear notices of alleged copyright infringement. This page explains the information that must be included in these notices, as required by the Digital Millennium Copyright Act (“DMCA”). Upon receipt of a DMCA compliant notice, the NCC will expeditiously remove or disable access to the content that is the subject of the notice.

If you are a copyright owner or an authorized agent thereof, and you wish to file a notice of infringement with us, then you may submit a notice by providing the NCC’s Designated Copyright Agent with the following information in writing (please consult your legal counsel or see 17 U.S.C. Section 512(c)(3) to confirm these requirements):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the NCC to locate the material on the NCC Site.
  • Information reasonably sufficient to permit the NCC to contact you, such as an address, telephone number, and, if available, an email address at which you may be contacted.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unsure whether the material available online infringes your copyright, we suggest that you contact an attorney before sending us a notice.

Counter-Notification

The administrator of an affected site or the provider of affected content may make a counter notification under Sections 512(g)(2) and (3) of the DMCA. If you elect to send the NCC a counter notice, to be effective it must be a written communication that includes the following (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):

  • A physical or electronic signature of the subscriber.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • The subscriber’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which the NCC may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.

Trademark Policy

The National Constitution Center owns multiple service marks and trademarks including but not limited to “America’s Town Hall,” “The National Constitution Center,” “NCC,” “Philadelphia Liberty Medal,” and the National Constitution Center Flag Logo (collectively the “NCC Trademarks”). 

All abbreviated reference to the National Constitution Center should be made to the “NCC.”

The National Constitution Center’s nonpartisan mission is to serve the nation and the world as a museum, a national headquarters for Civic Education, and a public forum for constitutional conversations. Towards these ends, the NCC provides live programs with leading historians, artists, and scholars, excellent educational content and exhibits in order to increase awareness and understanding of the U.S. Constitution.  Nonpartisanship is central to the NCC mission. The NCC seeks to inspire active citizenship by celebrating the American constitutional tradition for all citizens. To protect our nonpartisan mission, the NCC permits the NCC Trademarks to be used only in connection with approved nonpartisan educational events, exhibits, and content.

While you are encouraged to use the NCC’s educational content for all the purposes permitted by the Terms of Use on the NCC Site, you may not use the NCC Trademarks without the NCC’s prior written permission for any other purpose.

The names and trademarks of third parties may also appear on the NCC Website from time to time; you may not use these names and trademarks without prior, written permission of their respective owners.

PERSONAL DATA AND OTHER INFORMATION WE COLLECT

Our primary goals in collecting Personal Data are to further our mission as the only institution in America chartered by Congress to disseminate information about the United States Constitution on a nonpartisan basis.

What is Personal Data?

When we refer to “Personal Data” in this Policy, we mean information that identifies, relates to, describes or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a specific person. This might be information that directly identifies someone, such as their name, or it may be information that identifies someone only when combined with other information available to us. Please note, except as provided under applicable laws, Personal Data does not include information that is publicly available through government records or information that has been deidentified or aggregated in a way that it cannot be used to identify a specific individual.

Categories of Personal Data We Collect

Depending on how you access, use, or otherwise interact with our Platform, we may collect the following categories of Personal Data about you:

  • Identifiers and contact information, such as your real name, alias, email address, telephone number, postal address, physical address, unique personal identifier, government-issued identification number, date of birth, online identifier, IP address, and other similar information
  • Demographic information, such as your age, gender, citizenship, and other similar information
  • Financial information, such as your bank account number, credit card number, debit card number, and other similar information
  •  Information related to donations, such as your donation history, pledges, and other similar information
  •  Internet and other similar network activity, such as your browsing history, search history, interactions with the online portions of our Platform, and other similar information
  • Location information, such as where you live, where you are located, and other similar information
  •  Information related to your interactions with our Platform, such as events you attend, publications you receive, and other similar information
  • Communication information, such as information contained in voicemails, chats, emails, comment and suggestion forms, and other similar information
  • Other information you provide us or authorize us to collect about you

Usage Information

In addition to Personal Data, we may collect certain information about the device you use when you access or interact with the online portions of our Platform in various ways, such as through the normal operation of those online portions of our Platform and through the use of cookies, pixels, and other web technologies (collectively, “Usage Information ”). Usage Information, by itself, generally does not identify the specific person using the device that generated it. This means that, unless required pursuant to applicable law, Usage Information will not be considered Personal Data and the ways we use Usage Information may differ from what is described in this Policy. However, if we link Usage Information directly with your Personal Data or other information that could identify you, we will treat the linked Usage Information as Personal Data and use the linked Usage Information as described in this Policy.

Depending on how you access or interact with the online portions of our Platform, the Usage Information we collect may include:

  • Device information, such as the IP address, general geographic location, operating system, browser type, language preferences, mobile phone number, device identifier, and other similar information associated with a computer or mobile device used to access or interact with the online portions of our Platform
  • Information about your access or interactions with the online portions of our Platform, such as links that are clicked, pages or screens that are viewed, access and session times, interactions with emails we send, and other similar information associated with access or interactions with the online portions of our Platform
  • The Identify of institutions that employ the user or which the user attends or is otherwise affiliated with
  • Information automatically collected by cookies and other technologies used on the online portions of our Platform
  • Any other information that a computer or mobile device automatically sends whenever connected to a website or online applications

HOW WE COLLECT PERSONAL DATA

Most of the Personal Data collected in connection with our Platform is collected directly from the individuals to whom the information relates. In some cases, we may receive Personal Data from third parties in the ways described in this Policy.

Directly from You

When you access, use, or otherwise interact with our Platform, or otherwise engage with us in connection with our Platform, such as requesting information, communicating with us, completing a form on our Website, making purchases from our Website, providing information to our employees or representatives over the phone, or otherwise interacting with us, we may ask you to provide us certain Personal Data. While you have the option not to provide us with the Personal Data we request, please note that for activities where the Personal Data we request is specifically required, such as payment information to purchase tickets on our Website, you may not be able to complete or engage in those activities if you do not provide us with the required Personal Data.

From Third Parties

We may receive Personal Data about you from third parties, including, without limitation, online and offline sources, entities affiliated with us, our service providers, social media platforms, our third party business partners, and other public or commercial sources of information (collective, “Third Party Sources”). We may receive Personal Data from these Third Party Sources in a variety of ways, including, without limitation:

  • We may receive Personal Data about you when you interact with us on, or share our content via, social media platforms. In some cases, you may be able to revoke our ability to receive Personal Data about you from social media platforms by applying the appropriate settings to your account with the applicable social media platform.
  • We may receive Personal Data about you from third parties that provide services to us through or in connection with our Platform (our “ Service Providers”). Our Service Providers may include, without limitation, third parties that host the online portions of our Platform, third parties that provide us services related to the communications we send and receive, and third parties that process transactions on our Website.
  • We may receive Personal Data about you from our third party business partners, including entities affiliated with us and other third party business partners (our “Business Partners”) pursuant to certain data sharing arrangements, including, without limitation, Personal Data we may receive from other charitable or educational organizations.
  • We may receive Personal Data about you from third parties whose content is linked to on the online portions of our Platform. Any links to other websites, applications, or other third party content on the online portions of our Platform are not an endorsement, authorization, or representation of our affiliation with that third party and we are not responsible for the content, privacy, or security policies or practices of any third party. We encourage you to read the privacy policies or statements applicable to any third party website, application, or content you access.
  • We may receive Personal Data about you from other third parties, such as other users of our Platform and those that refer you to our Platform.

Please note, we may combine the Personal Data and other content and information we receive about you from multiple sources, including, without limitation, Personal Data we collect directly from you and one or more Third Party Sources.

HOW – AND WHY – WE COLLECT USAGE DATA

We collect Usage Information in a variety of ways and for a variety of purposes. Some Usage Information, such as the IP address of a device attempting to access or interact with the online portions of our Platform, is necessary for us to make those online portions of our Platform available. Other Usage Information, such as information about which features of the online portion of our Platform are popular, help us improve and advertise our Platform. The primary systems and technologies we use to collect Usage Information are:

  • The systems we use to make the online portions of our Platform available to you, including the systems we use to help us identify and address technical issues and errors. When a computer or mobile device accesses or interacts with the online portions of our Platform, these systems automatically record certain information that a computer or mobile device sends whenever it connects to a website or utilizes an online application, as well as information about how long the computer or mobile device is connected to certain online portions of our Platform, such as our Website, and the activities and actions associated with that computer or mobile device while connected.
  • Cookies, which are small data files that are uploaded to the hard drive or other storage on computers and mobile devices that access or interact with the online portions of our Platform. Among other things, cookies help us to improve our Platform and our users’ experience. We use cookies to see which areas and features of the online portions of our Platform are popular and to understand usage of the online portions of our Platform. We use first and third party cookies (including MetaPixels and Linkedin insight tabs), which are cookies that are placed by other parties we work with, such as Google, Meta and LinkedIn.   • Third party analytics tools, such as:

Google Analytics. Google Analytics is a web analytics service provided by Google, Inc. (“Google”) that assists us in understanding how certain online portions of our Platform are used. Google Analytics places cookies on computers and mobile devices that generate information we select about the use of the online portion of our Platform, including their IP address. That information will be transmitted directly to and stored by Google. The information will be used for the purposes of evaluating the use of the online portion of our Platform, compiling reports on activity on the online portion of our Platform for our use, and providing other services relating to activity on, and usage of, our Platform. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google Tag Manager. Google Tag Manager is a tag management tool provided by Google that helps to manage website tags through a single interface. Google Tag Manager triggers other tags that may collect information, including Usage Information and Personal Data. However, Google Tag Manager does not access this data. Google Tag Manager also enables the use of Google Analytics. If you have opted out of Google Analytics, Google Tag Manager takes this opt out into account. Pixels. A pixel is a tiny image that may be embedded within web pages and emails, requiring a call (which provides device and visit information) to the pixel originator’s servers so that the pixel can render web pages and emails. We use pixels to learn more about your interactions with email content or web content, such as whether you interacted with ads or posts. Pixels can also help us and third parties to place cookies on your browser.

We use pixels to customize our advertising and to serve you ads on social media based on your browsing behavior. Pixels allow us to understand how you may get redirected to our Website by clicking on an ad. Pixels store a cookie on your device to enable us to measure the effectiveness of ads for statistical and market research purposes. We do not have access to the information collected through the pixels.

Please note, we have not yet developed a response to “Do Not Track” signals and do not change any of our data collection practices when we receive such signals. We will continue to evaluate potential responses to “Do Not Track” signals in light of industry developments or legal changes.

We will not collect additional categories of Personal Data or use the Personal Data we collect or receive in connection with our Platform for materially different, unrelated, or incompatible purposes without providing you notice.

  • otherwise promoting and marketing the products and services we provide as permitted by applicable laws

Anonymized Data

Please note, we may use and disclose aggregated, anonymized, or de-identified information we collect or receive in connection with our Platform along with other information that does not identify a specific individual (“Anonymized Data”) for any lawful purpose, which may include, without limitation, purposes not described in this Policy. Except as otherwise required under applicable laws, our use and disclosure of Anonymized Data is not subject to this Policy.

HOW – AND WHY – WE DISCLOSE YOUR PERSONAL DATA TO THIRD PARTIES

To operate our Platform and carry out other activities permitted by applicable laws, we may disclose certain Personal Data that we have collected or received in connection with our Platform with certain third parties under the following circumstances:

  • We will disclose your Personal Data to any third party to whom you consent or instruct us to provide your Personal Data.
  • We may disclose your Personal Data to our Service Providers as needed to complete any transaction or provide any service you have requested related to or in connection with the services they provide to us, including, without limitation, order fulfillment, marketing our Platform, data hosting, fraud protection and prevention, and as otherwise described in this Policy. We require these Service Providers to exercise reasonable care to protect your Personal Data and restrict their use of your Personal Data to the purposes for which it was provided to them.
  • We may disclose your Personal Data to our Business Partners for our or their operational and marketing purposes.
  • We may disclose your Personal Data to other charitable or educational organizations whose products or services may interest you. You may contact us at [email protected] for a current list of organizations with whom we disclose Personal Data.
  • We may disclose your Personal Data to applicable third parties in connection with a merger, acquisition, bankruptcy, or other sale of all or a portion of our assets. We reserve the right, in connection with these types of transactions, to transfer or assign your Personal Data and other information we have collected or received to third parties or to authorize such third parties to use any such information. Except as ordered by a bankruptcy or other court, the use and disclosure of all transferred Personal Data will be subject to this Policy. However, any Personal Data you submit or that is collected or received after this type of transfer may be subject to a new privacy policy or statement adopted by the successor entity.
  • We may disclose your Personal Data to government or law enforcement officials or private parties where necessary to enforce and comply with the law. To the extent permitted under applicable laws, we may disclose any Personal Data and other information to government or law enforcement officials or private parties we believe is necessary or appropriate to investigate, respond to, and defend against legal claims, for legal process (including subpoenas), to protect our or a third party’s property and rights, to protect us against legal liability, for the safety of the public or any person, to prevent or stop any illegal, unethical, fraudulent, abusive, or legally actionable activity, to protect the security and integrity of our Platform and any equipment used to make our Platform available, or to comply with applicable laws.

Additional Tools for Communications

For marketing and other promotional email communications you receive from us, you can opt-out of receiving such communications by following the unsubscribe instructions contained in most email messages from us. Your unsubscribe request or email preference changes will be processed promptly, though this process may take several days. During that processing period, you may receive additional marketing and other promotional email communications from us. We do not direct or target any piece of our Platform to children under the age of 13. If you are a California resident, under California’s Shine the Light Law (California Civil Code Section 1798.83) you have the right to request the following information regarding our disclosure of your Personal Data to third parties for their direct marketing purposes: (1) the categories of Personal Data we disclosed to third parties for their direct marketing purposes during the preceding calendar year; (2) the names and addresses of the third parties that received the information; and (3) if the nature of the third party’s business cannot be determined from their name, examples of the products and services they marketed. Onsite Photography and Filming

When entering the National Constitution Center (NCC), you enter an area where photography, audio, and video recording may occur. By entering the premises, you consent to photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, webcasts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose, by the NCC, its affiliates and representatives. Please notify a staff member/volunteer if you do not want to be photographed or filmed.

Visitor Conduct Policy

The National Constitution Center (NCC) brings together people of all ages and perspectives, to learn about, debate, and celebrate the greatest vision of human freedom in history, the U.S. Constitution. The NCC is a place for everyone to engage in civil dialogue, share diverse viewpoints, and learn about their place in the story of “We the People.” Creating a welcoming environment is a shared responsibility of the NCC community. We expect every person in our museum to treat each other with respect and to help maintain a safe environment. The NCC prohibits harassment or discrimination of any kind. We strive to provide a fun, fulfilling, positive learning experience for all.

By visiting the National Constitution Center, you are agreeing to comply with the following requirements for visitor conduct.

The following is prohibited in the museum:

  • Possession of a weapon of any kind. The prohibition applies to all visitors, including those with firearm permits, but not to law enforcement personnel on duty who are authorized to carry firearms.
  • Displaying or carrying any placard, sign, or banner
  • Destroying, defacing, damaging, or removing any NCC property, including all artifacts and exhibits
  • Climbing upon any part of the building or exhibit spaces
  • Loitering, sleeping, or participating in unpermitted assemblies
  • Creating any hazard to persons or things
  • Performing or threatening to perform, any obscene, violent, or abusive act and/or language
  • Using, possessing, or selling illegal drugs
  • Taking photographs for advertising or any other commercial purpose without prior written approval of the NCC
  • Soliciting for commercial or charitable purposes or distributing advertisements, pamphlets, handbills, and flyers
  • Smoking or carrying lighted cigarettes/electronic cigarettes, cigars, or pipes into building, or having a fire of any kind on the premises is prohibited
  • Bringing pets to the museum. Service animals are welcome.

Reporting: If you are a visitor and you witness or experience any of the behaviors above, we strongly encourage reporting it to the museum manager by finding a staff member and asking to speak to the manager. If you do not immediately see a staff member, please proceed to the information desk in the main lobby of the first floor, where a staff member will be there to assist you. The National Constitution Center reserves the right to refuse or revoke the admission or membership of any visitor or group whom it believes violates these guidelines. This can include future admission to the museum and is at the sole discretion of NCC.

Program and Event Code of Conduct

In an effort to provide an enjoyable and safe environment for all guests and employees at National Constitution Center public programs and special events, all guests and employees in attendance are expected to conduct themselves in a manner that respects others and does not bully, endanger, discriminate against, or harass anyone partaking in or attending NCC programs or events. The NCC does not tolerate discrimination or harassment in any form.

The National Constitution Center reserves the right to remove and/or refuse entry to anyone who fails to abide by the NCC’s rules and policies. This includes, but is not limited to, anyone who disrupts or threatens to disrupt a program or other guests’ ability to experience the program, or harasses another guest or NCC employee.

All determinations are at the sole discretion of the NCC. A breach of the Code of Conduct may result in suspension from future America’s Town Hall programs, membership, or other NCC programs or events. Individuals expelled due to violating the Code of Conduct will not be eligible for a refund or other consolation.

Reporting: If you or someone else is being discriminated against or harassed at an NCC program or event, please report it as soon as possible. You can make a report in person to NCC staff, online, or by phone. Reporting may also be anonymous. Onsite and during business hours at the NCC, please see the information desk or any NCC staff member for assistance. Outside of business hours, please contact [email protected]. If you need immediate emergency assistance, please contact 911.

This Code of Conduct applies to all NCC events, including events hosted at the NCC, NCC-sponsored events hosted offsite, and online programs.
